Water abstraction disclaimer

Individuals and organisations who have been granted a water abstraction licence by NRW (‘Licensees’) are subject to contractual and/or statutory obligations to monitor, calculate and submit reports relating to their water usage to ensure that they operate within the terms of their licence.

The submission of water usage calculations via NRW’s Water Abstraction Portal (the ‘Portal’), is one way for Licensees (or parties acting on a Licensee’s behalf) to submit information relating to a Licensee’s water usage.

However, the water usage calculations and historical water abstraction data available through this Portal are made available by NRW as a guide only. They are not intended to replace the contractual and/or statutory responsibility of a Licensee to accurately calculate the volume of water they abstract and ensure that they operate within the terms of their licence.  Licensees should not, therefore, rely on either the water abstraction calculations or historical data available via this Portal.

NRW makes no representation and gives no warranty, whether express or implied, relating to the accuracy of any calculations or historical water abstraction data available via this Portal or that the same will be complete or up to date. NRW also accepts no liability to its Licensees (or any party acting on behalf of a Licensee), whether in contract, tort or on any other basis, in respect of such calculations or data.

The above disclaimer does not seek to exclude or limit NRW’s liability where it would be unlawful to do so, including, without limitation, for liability for death or personal injury caused by NRW’s negligence or the negligence of its employees, agents or subcontractors.
