By engaging with developers, we aim to avoid costly delays and achieve better environmental outcomes. However, we regularly receive requests for advice which go significantly above what we have to provide as part of our duties and responsibilities. For that reason we are changing the way in which we provide advice to you.
In April 2017, we launched our Discretionary Planning Advice Service, which sees the introduction of charges for certain types of advice. This service is currently available for advice on a limited number of topics and is offered on a voluntary basis. This means that there is no obligation on you to make use of the service.
We have produced a guide which explains in more detail which services you can request from us, what is offered for free and where charges apply. This also explains how each of the services can be requested from us. This guide can be downloaded from the bottom of this page. We recommend that you read this guide to inform your decision about what level of service you would like to request from NRW.
As well as our guide for developers, we have made a number of topic-based guidance notes available on this web site. These provide more information about some of the issues that you will need to consider as part of your application.
Please note that this webpage focusses on the advice we provide as part of our role as an adviser in the development planning system. NRW also has a role as a regulator, which is not covered in this document. More information and guidance on our regulatory service can also be found on our website.
What is covered by the Discretionary Planning Advice Service?
The Discretionary Advice Service (DAS) is currently limited to advice on the following subjects and development types:
- Groundwater protection
- Land contamination
- Flood Consequence Assessments
- Developments of National Significance
- Nationally Significant Infrastructure Projects
- Marine developments (from April 2018)
Over time we intend to roll out the service to all the discretionary advice that NRW provides. As well as the DAS, we can offer you extra advice on certain types of licenses and application.

How much will it cost?
We have set our rates for the DAS at a level which ensures full recovery of our costs. The advice will be charged at £125/hr + VAT. We will only charge for discretionary advice provided by us. All our other advice provided by us, such as advice provided as part of our statutory duties, and our initial opinion, will remain free of charge.
If you are interested in making use of the DPA service, we will put together an estimate for the work. It will then be up to you to decide if you wish to proceed.
